  • Settlement of toxics lawsuit re: WW II GW contamination gives Southern California city a major legal victory over US Army (Riverside Press Enterprise, August 14) Consent Decree includes EPA (USEPA Region IX Press Release, August 13)
    Commentary: The City of San Bernardino's reward for hanging tough through 8 years of litigation is a $69 million settlement. After TCE and PCE were detected in a crucial city well field in 1980, the City worked with 3 state agencies (implementing SDWA, CWA and CERCLA) and then EPA to identify a WWII Army base as the likely source of the contamination. Lawsuits by the state toxics agency and the City were combined as the City sought to recover a major source of its drinking water with installation of multiple air stripping/carbon treatment plants. Looking for a "plausible alternative" cause of the GW contamination to lay before the court (also known as "grasping at straws"), the Army's US Attorneys tried to blame the VOCs on the discharge of first-rinse water from newly-coated drinking water storage tanks. The funds are committed to a future 50+ years of ongoing cleanup of the groundwater basin and providing drinking water treatment and......of course, no blame is admitted in the settlement.
